Medical-Legal Consultants' analysis of a case involves some or all of the following procedures, depending on the type and complexity of the case.
- Initial consultation, by telephone or in person, to review the basic facts of a case. This can determine:
- if a useful analysis is possible
- what additional information and expert input will likely be required
- an estimate of costs
- Review and analyze medical records, both pre- and post-accident, to determine role of pre-existing conditions on current claims.
- Review supporting documents, such as interrogatories, statements, depositions, and other relevant case data.
Inspect accident scene and associated objects, such as vehicles, clothing, machinery, on-site hazards, and available protective devices. Evaluate effectiveness of protective devices such as restraints, guards, and helmets.
- Review and assemble pertinent scientific, medical, and engineering research and publications.
- Develop computer or laboratory-based simulations and re-creations of injury causation; or create re-enactment at scene.
- Summarize and present analysis.
- Prepare documentation and exhibits for deposition, arbitration, mediation, and/or courtroom trial. Exhibits may include photographs, charts, graphs, anatomic models, animations, and literature summaries.
